Background: HB76 proposes a constitutional amendment to abolish the death penalty in Alabama by providing that no crime may be punishable by death and requiring the Legislature to enact laws prohibiting capital punishment while rendering void any existing law authorizing a death sentence. The legislation would be submitted to voters at the statewide primary election in 2028.

Position: We support HB76. The death penalty is not and cannot be applied fairly, accurately, or without bias. Abolishing capital punishment helps protect against wrongful executions and moves Alabama toward a justice system rooted in human dignity and equal protection under the law. The death penalty also diverts resources away from supports that actually improve public safety, like survivor services and prevention. Alabama should not have the power to take human life as punishment.
