The following is a statement from Susan Watson, executive director of the ACLU of Alabama regarding the Tenth Circuit Court of Appeals decision today that same-sex marriage is protected by the Constitution:

“Marriage is a constitutional right for all Americans and no state can deny it or the protections it provides because of the sex of the individuals in that marriage, Alabama included. We want all Alabamians to have equal protection and rights under the law.”

Randall Marshall, legal director of the ACLU of Alabama adds that this bodes well for our recent marriage equality filing:

“The decision by the Tenth Circuit Court of Appeals is the first federal appellate court to consider the issue and it has ruled that same-sex marriage is protected by the Constitution. The decision continues the momentum that has occurred since Windsor – every federal court to consider the question has ruled the same way: same-sex marriage must be recognized.”
